The use of our services constitutes an agreement by the customer to be bound to our terms of services defined below. These terms also include the Acceptable Use Policy which forms an integral part of it.
This agreement shall be effective as soon as a service is ordered AND paid for. This agreement shall be renewed each time the customer renews his services with Namworld. This agreement will expire as soon as the customer no longer has active services with Namworld.
The customer warrants that all personal information provided when signing up with Namworld is accurate and will be kept up to date. Namworld will rely on this information for all contact needs and notices sent to the customer. Namworld shall not be held liable for any cancellation of services or other problems arising from correspondence not received because of:
The customer warrants us that he is of legal age in his country to enter into this agreement.
Engaging in a recurring payment service does not constitute an engagement from Namworld to provide the service at said price continuously. The price applies only to the service duration for which the previous payment was made. Fees for renewing your service may be different from the original fees. The customer will receive a notice 30 days before billing prices are updated. Past this delay, if the customer has not requested cancellation of his service, it will be considered that the customer has accepted the new recurring price for his services.
When you modify or cancel a subscription service, you will be credited at the pro-rata of paid price for the time remaining on the modified or canceled service. This credit can be used for your next services. This credit is not refundable in cash.
Namworld shall provide upon request 1 free month of equivalent web hosting service for each month during which the involved service has been available for less than the claimed availability guarantee on your web hosting service. This does not include unavailability caused by incorrect configurations or any other cause arising from the customer, software updates or persons outside of Namworld and its employees. These compensations apply only to the server's availability.
Additionally, if the uptime during 1 month falls under 98% on any server, all customers on this server will be given one month equivalent credit for their next purchases. In this case, No request will be needed to receive this credit.
You may contact us within 15 days of purchasing our hosting services if you're not satisfied to get a refund. It applies to the 15 days after your FIRST order only (payment day). Any subsequent hosting orders or payments from the customer are not eligible to this guarantee.
This refund may be reduced by a small fee not over $0.30, at our discretion, for unrefundable transactions cost we incure when accepting payments.
You are not eligible to claim this money back guarantee if your account is suspended or terminated for breach of terms of services. See Acceptable Use Policy and Suspension and Termination of Services
We do not offer refunds of our services unless you disapprove changes to our terms of service. In the case you notify us within 30 days of a change to the terms of services of your disagreement with our new terms of services, you will be refunded every active services paid for, except the non-refundable services defined in the Non-Refundable Services section below. Services will be refunded at the pro-rata of paid price for the remaining time of the service.
The customer's services may not be suspended or terminated by Namworld, unless:
Any customer who initiates a chargeback for services he has received will be invoiced for any chargeback fees incurred by Namworld, his services will be terminated and he may be prosecuted to retrieve all due amounts as mentioned in the Unpaid Services section.
The customer's services are associated to servers which, like computers, have components that may break and require replacement. While we strive to keep our services stable, redundant and secure, they are not 100% reliable as this is impossible. This could cause inconveniences and losses for your business. At the price paid for the services, the services are provided "as is" and we cannot insure possible losses for the customer. See the Refunds section.
In any case, the customer will not be entitled to any compensation for the loss of his data or files. This applies to loss of data due to hardware failure, services termination or any other cause which would make the customer's data impossible to recover. It is the customer's responsibility to backup a copy his data and files as this service is NOT offered by Namworld.
EXCEPT FOR WARRANTIES INCLUDED IN THESE TERMS OF SERVICE AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, ALL SERVICES ARE PROVIDED ON AN "AS IS" BASIS AND NAMWORLD DISCLAIM ANY AND ALL WARRANTIES INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PURPOSE, TITLE AND NON-INFRINGEMENT.
TO THE EXTENT PERMITTED BY LAW, IN ANY CASE, NAMWORLD WILL NOT BE HELD LIABLE FOR ANY LOSS OR DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF DATA, OR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL DAMAGES OR LOSSES, EVEN IF NAMWORLD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH RISKS OR DAMAGES) ARISING FROM THE USE OF OUR SERVICES OR IMPOSIBILITY TO USE OUR SERVICES. THIS LIMITATION APPLIES TO ANY CASES NO MATTER WHO IS RESPONSIBLE FOR SUCH DAMAGES, EVEN IF THEY COULD HAVE BEEN AVOIDED. THE MAXIMUM AGGREGATE LIABILITY OF NAMWORLD AND ITS EMPLOYEES OR REPRESENTATIVES SHALL BE THE PAYMENT OF MONEY NOT EXCEEDING THE PAYABLE AMOUNT FOR 3 MONTHS OF THE SERVICES INVOLVED.
Customer agrees to pay Namworld reasonable costs for collection of due money for any unpaid services you received, including but not limited to collection agency fees, attorney fees and court costs. This does not apply to recurring services which will simply not be renewed when unpaid.
Namworld may update his network including, but not limited to, hardware, software and service providers. This may interfere with the customer's services. Updates are almost always compatible with older content, but Namworld shall not be held liable for ANY harm to the customer resulting from such updates. The customer should keep his scripts up to date and compatible with the latest software versions applicable to them. UPDATES' UNAVAILABILITY TIME IS VALID WHEN CALCULATING UNAVAILABILITY TIME FOR THE AVAILABILITY GUARANTEE.
Namworld will not be held liable and will be free of any obligations to provide the services to the customer under this agreement in the case failure to provide the services are due to events beyond Namworld's control, including but not limited to: natural disasters, labor strikes, war, riots, terrorism, power grid failure, Internet failure and any other events for which precautions are not usually taken or cannot be taken.
The agreement shall not be governed by the United Nations Convention on the International Sale of Goods. This agreement shall be governed by the laws of Quebec and of Canada.
We reserve ourselves the right to change these Terms of Service, in their integrality, at any time. You will receive a 30 days prior notice to the email address provided when you signed up for one of our services. You have 30 days after the notice is sent to you to notify us you disagree with the new terms. After this delay, it is considered you have agreed with the new terms and conditions. If you disagree with the new terms, this agreement shall be terminated, services canceled and you will be refunded for any services currently used as defined in the Refunds section.
The customer warrants Namworld that his use of our services will respect laws of the United States, Canadian laws as well as the customer's local laws. The customer is also solely responsible for all files on their web hosting services, including those uploaded by a compromised script. It is the customer's responsibility to verify that his content is legal and that his scripts are secure to use.
